1. These terms and conditions specify and regulate the terms of use of the “www.FinePassport.club” website, located at https://www.finepassport.club, as well as the “FinePassport – Employee Benefits Club” application, owned by “Sanremo Ventures Ltd.” (Registration No. 516127263), the licensee of SafePOB GMBH in Israel (hereinafter referred to as the “Website,” “Application,” or “FinePassport”), which operates the “FinePassport Club” (hereinafter – the “Club”).

2. The provisions of these terms and conditions apply equally to all genders, and the use of masculine language is for convenience only. The headings in this document are for convenience and will not be used for interpretation or any other purpose.

3. Any use of the Website or Application, receipt of services, purchase of products, or participation in activities through the Website and/or Application is subject to these terms and conditions. By using the Website or Application, you agree to all the terms detailed herein, as updated from time to time, and confirm that all the details you provided are accurate and correct.

4. FinePassport reserves the right to change these terms and conditions from time to time at its sole discretion and in accordance with the law.

5. From the date of such changes, the updated version of the terms and conditions will apply and be binding.

6. These terms and conditions were last updated on January 5, 2024.

Liability

7. FinePassport and/or its representatives are not parties to any transactions for the purchase of products, benefits, promotions, attractions, or any activities offered on the Website or Application. Any advertisements on the Website or Application do not constitute recommendations by Sanremo Ventures, and FinePassport is not liable for any damage of any kind, directly or indirectly, caused to Club members, their representatives, or any third party concerning products and/or services (including attractions or activities) purchased through the Website or Application. This includes but is not limited to defects in products and services, discrepancies between the product or service and its description on the Website or Application, etc.

8. Images, photographs, and descriptions displayed on the Website or Application are provided by the respective businesses and suppliers “as is” and are for illustrative purposes only. They should not be considered binding descriptions of the products or services offered. Variations or changes may exist between the displayed items and the actual products or services. The suppliers bear sole responsibility for the characteristics, quality, manufacturer name, and any representations (if provided) regarding the products or services.

9. Suppliers bear sole responsibility for their products and services (including attractions or activities), their delivery, quality, durability, and compliance with the terms listed on the warranty certificate accompanying the products, where applicable. Suppliers are solely responsible for fulfilling obligations imposed on “businesses” under the Israeli Consumer Protection Law of 1981 and the German Civil Code (BGB) concerning the products and services offered on the Website and Application.

10. Suppliers are not responsible for the installation of a product requiring a technician if the installation is carried out by the purchaser or their representative.

11. FinePassport is not the initiator, producer, organizer, or marketer of any event or show listed on the Website. Purchasing a ticket constitutes a contractual relationship solely between the buyer and the event organizer. FinePassport only sells tickets.

12. FinePassport is not liable for event cancellations, changes, delays, venue alterations, disruptions, ticket availability, denied entry, or any other matter related to the event, including damages (property or bodily harm) incurred inside or outside the event venue.

13. Club members will not have any claims against FinePassport regarding the policies of the event venue. Ticket holders are responsible for reviewing and adhering to the venue’s policies before attending the event.

14. FinePassport is not liable for the removal of ticket holders from an event venue due to violence, possession of hazardous materials, weapons, or other reasons, nor for denied entry due to lateness or any other reason. In such cases, ticket holders are not entitled to refunds or compensation from FinePassport.

Registration for the Website/Application

15. To access the Website and/or Application, users must log in with their ID number and a personal password chosen during the first login or by entering their ID number and receiving a one-time code sent to the mobile number associated with the ID.

16. When placing an order, users must provide identifying details, including their ID number and payment information, as specified during checkout.

Information Displayed on the Website

17. Each product or service listed on the Website is published with a “Benefit Page” detailing relevant information and purchase conditions.

18. The product or service details on the “Benefit Page” are provided by the respective businesses and suppliers. While FinePassport makes efforts to verify the accuracy of the information, it is not responsible for inaccuracies regarding the products or services, including their quality, price, availability, delivery times, warranty, technical specifications, etc.

19. The benefit price is not necessarily the lowest price available for the product or service. Buyers are responsible for comparing prices before making a purchase.

20. The list of participating branches in promotions may change from time to time. Buyers should contact the branch or network before visiting.

21. Some discounts provided directly at businesses are applied automatically at checkout. Discount rates and agreements may change or be canceled without prior notice.

22. The information on the Website does not constitute an offer, solicitation, or advice to purchase any product or benefit or to perform any action.

23. Benefits for closed events or shows can only be redeemed on the date specified on the Website.

Purchase Process

24. Redeeming benefits or promotions requires personal identification and proof of Club membership during payment.

25. Unless stated otherwise, Club members may purchase tickets, benefits, or promotions for themselves, their spouse, and their children under 21 years old. Tickets or benefits purchased for others will be charged at full price.

26. Some Club membership conditions require saving credit or debit card details in the system for future purchases or recurring payments. This information will be stored securely according to PCI standards and in compliance with the GDPR.

27. Certain actions can also be performed via FinePassport customer service.

28. After completing a purchase, an order confirmation will be sent to the buyer.

29. Orders are considered valid only after payment details are verified, and authorization is received from the credit card company.

Right of Cancellation (in compliance with Israeli and German Law)

30. Club members may cancel their purchase of a product or service in accordance with the Israeli Consumer Protection Law of 1981 and the German Civil Code (BGB).

31. Cancellation of a transaction must be requested in writing, either via email to Service@finepassport.club or through the contact form on the Website.

32. Cancellation of a product purchase is allowed within 14 days of receipt of the product or from the date of the transaction, whichever is later, provided the product is returned unused and in its original packaging.

33. Cancellation of services is allowed within 14 days of the transaction date, provided the service has not yet been rendered.

34. Refunds for cancellations will be issued within 14 business days of the product being returned or the cancellation request being approved, subject to applicable fees as permitted by law.

35. Certain products and services, such as tickets to events or custom-made products, may not be eligible for cancellation. These exceptions will be clearly indicated on the “Benefit Page” of the product or service.

Data Sharing, Management, and Third-Party Access

36. SafePOB GMBH may share all customer information provided to FinePassport.club with other affiliated FinePassport clubs worldwide. This enables the automatic creation of accounts for customers and club members in other FinePassport clubs globally. SafePOB GMBH will manage the data provided under the same terms and conditions outlined in this document, ensuring compliance with GDPR and applicable data protection laws.

37. FinePassport.club may share personal data with third-party suppliers, service providers, and partners when necessary to provide services requested by the customer or club member. This includes but is not limited to financing services, delivery services, and other benefits offered through the platform.

38. Customers may withdraw their consent for data sharing at any time by contacting customer support at Service@finepassport.club. However, withdrawing consent may limit the ability to access certain services or benefits.

Purchase Quantity Restrictions on the Website and Application

39. Purchasing discounted products or services is limited to 10 purchases per product or service.

40. Restaurant and café vouchers: Each calendar month, FinePassport members may purchase one voucher of this type at a Club price, subject to the terms of the Website. Additionally, a maximum of 20 such vouchers may be purchased annually at any price. [Version 06012025]
