Terms and Conditions for Fine Passport Club (IL) Website and Application

Membership Termination

Fine Passport Club (IL) reserves the right to accept or terminate any membership at its sole discretion and decision, effective immediately. By joining the club, members acknowledge and agree to this condition.

Product/Benefit Delivery

1. The details provided by the club member in the Fine Passport Club (IL) registration form are considered official and will be used for delivering products, benefits, and services. Members are responsible for ensuring the accuracy and completeness of their information.

2. Responsibility for updating personal details lies solely with the member. Fine Passport Club (IL) and its representatives are not liable for errors, including loss of benefits or failure to receive notifications related to the club, such as issues with product or service delivery.

3. If incorrect identification details are provided during an order, resulting in the return of products or benefits to the supplier, the purchaser will bear all associated shipping and handling fees as determined by Fine Passport Club (IL) or the supplier.

4. Delivery of products or benefits will follow the terms specified on the respective sale page.

5. Delivery times are calculated based on business days (Sunday through Thursday, excluding holiday eves and public holidays). Suppliers will make reasonable efforts to expedite delivery.

6. Products or benefits sent to the purchaser’s home will be delivered via couriers or Israel Post to the address provided during purchase unless otherwise noted. Delivery will adhere to these terms.

7. Fine Passport Club (IL), its suppliers, and representatives are not responsible for delivery delays caused by circumstances beyond their control, including but not limited to strikes, system malfunctions, email disruptions, event cancellations, acts of hostility, natural disasters (e.g., pandemics, earthquakes, severe weather), government decrees, or other force majeure events. In such cases, either party may cancel the transaction without penalty.

8. Products or benefits delivered via Israel Post will be subject to Israel Post’s delivery times and service conditions.

9. Delivery times for non-courier services are beyond the control of Fine Passport Club (IL) and its suppliers. By completing a purchase, the purchaser agrees not to hold Fine Passport Club (IL) or its suppliers liable for delays caused by such methods.

10. Courier deliveries will follow the courier company’s terms as determined by the supplier. If delivery cannot be completed due to circumstances such as weather conditions or security concerns, an alternative arrangement will be made with the purchaser.

11. Exceptional transportation requirements (e.g., special equipment or deliveries to high floors without elevators) will incur additional costs, which are the sole responsibility of the purchaser.

12. Delivery fees charged to the purchaser include packaging costs, product insurance during shipping, and actual shipping expenses.

Prices and Payments

13. Purchases can be made using credit cards, debit cards, gift cards, preloaded club member cards, or one-time voucher codes provided by the purchaser. Additional shipping and handling fees will apply as specified on each product’s sale page.

Note: For debit card installment payments or bank transfers or checks sent, ownership of the product remains conditional until all payments have been completed on time and in full.

14. All prices listed on product sale pages include local VAT unless explicitly stated otherwise.

15. For products or services priced in foreign currency (e.g., flights or vacations abroad), exchange rates will be calculated based on the “high cash rate” (the bank’s cash transaction rate) on the order date unless otherwise stated.

16. An invoice will be issued for all purchases as required by law in the name of the purchasing club member.

Cancellation of Purchase and Return of Products

17. Purchasers will receive confirmation of their order details after completing a purchase. It is their responsibility to review these details for accuracy.

18. Purchase cancellations will comply with applicable laws, including Israel’s Consumer Protection Law:

– Cancellation notices must be sent via email to **Service@sanremoventures.com** or via WhatsApp (contact details on the website) within 14 days of purchase.

– For individuals with disabilities, senior citizens, or new immigrants (as defined by law), cancellations can be made within four months if a conversation occurred during purchase.

– Cancellation fees may apply (up to 5% of the transaction value or ₪100, whichever is lower). If a product is defective or does not match its description, Fine Passport Club (IL) will arrange a return at no cost to the purchaser.

19. Products that can be recorded, duplicated, or copied cannot be returned if their packaging has been opened.

20. Services such as hosting, catering, travel, vacations, entertainment (e.g., shows or attractions) cannot be canceled if their scheduled date is within seven business days from purchase.

21. Lost or damaged vouchers are treated as cash and cannot be refunded.

22. If a purchaser cancels a transaction for reasons unrelated to non-conformity, late delivery, or breach of contract by Fine Passport Club (IL), they must return any received products at their own expense.

23. Partial order cancellations are not permitted.

24. Refunds require the return of any original invoices via registered mail or in person to Fine Passport Club (IL)’s offices.

Access Blocking

25. Fine Passport Club (IL) reserves the right to block access to its website/application at its discretion under circumstances such as:

– Actions causing harm (or potential harm) to Fine Passport Club (IL) or third parties.

– Unauthorized commercial use of the platform.

– Privacy violations or attempts to collect user data.

– Illegal activities under Israeli law.

– Violations of these terms.

– Actions preventing others from using Fine Passport Club (IL)’s services.

– Introduction of malicious software (e.g., viruses).

– Displaying Fine Passport Club (IL) content in unauthorized frames.

– Linking to Fine Passport Club (IL) from illegal/offensive websites.

– Accessing Fine Passport Club (IL) from unsupported locations.

– Any action lacking good faith.

Intellectual Property

26. All intellectual property rights related to Fine Passport Club (IL)’s website/application are owned exclusively by Fine Passport Club (IL) (SafePOB GMBH) or its appointed entities. Unauthorized use is prohibited without prior written consent.

27. Copying, publishing, distributing, or transmitting materials from Fine Passport Club (IL)’s website/application is prohibited without explicit authorization.

28. Automated tools for copying content from Fine Passport Club (IL)’s website/application are strictly prohibited.

29. Fine Passport Club (IL) reserves the right to remove unauthorized links to its website/application at its discretion.

30. Fine Passport Club (IL) is not liable for damages resulting from unauthorized links or displays of its content on other platforms.

Links and Third-Party Content

31. The website/application may contain links to third-party content/services not controlled by Fine Passport Club (IL). Fine Passport Club is not responsible for these services or their content.

32. Fine Passport Club (IL) may transfer its rights related to its website/application to another entity that agrees to these terms.

Disputes

33. In case of disputes between Fine Passport Club (IL), operated by Sanremo Ventures Ltd., and a club member that cannot be resolved amicably, the matter will be referred to Fine Passport Club’s CEO (or an appointed representative) for resolution.

34. Payment Obligations and Debt Collection

Fine Passport (IL), operated by Sanremo Ventures Ltd., reserves the right to pursue and collect any unpaid payments immediately using any available means of charging in its possession. This includes initiating legal proceedings, suing for damages, or exercising the authorization signed by each club member to deduct any outstanding debt directly from the club member’s paycheck. Under no circumstances does this provision diminish the consumer’s responsibility to settle all outstanding debts in full.

35.Jurisdiction: These terms and conditions are governed by the laws of the State of Israel. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel. [Version 06012025]
